A Wage Claim
W.S. 27-4-504 — a written claim to the department, and fifteen days to ask for a hearing
The department of workforce services takes written claims for unpaid wages, investigates them and decides whether they are valid. Outside bankruptcy, a claim it takes is limited to two months of wages for each employee.
Who handles this in Wyoming: legal aid programs, lawyer referral and the state offices, listed in the Wyoming directory.
- An employer or employee who disagrees with the decision may ask for a fair hearing, in writing, within fifteen calendar days of receiving it.
- Once a valid claim is final, the department orders the employer to pay and, with the county attorney, goes to court to collect.
- An employer that does not comply with the order can be fined up to $200 for each day.
Retaliation. Firing, harassing, disciplining or otherwise discriminating against an employee for filing a wage claim, complaining, or taking part in a proceeding is unlawful. The employer can be ordered to reinstate the employee and pay lost wages plus an equal amount as liquidated damages.
