Equal Pay
W.S. 27-4-302 — equal pay for equal work regardless of gender, and double the shortfall
An employer may not pay employees of one gender less than employees of the other in the same establishment for equal work that takes equal skill, effort and responsibility under similar conditions.
Who handles this in Wyoming: legal aid programs, lawyer referral and the state offices, listed in the Wyoming directory.
- A difference is allowed under a seniority system, a merit system, a system that measures earnings by quantity or quality of production, or any factor other than gender.
An employer that violates this owes the unpaid wages plus an equal amount as liquidated damages. An agreement to work for less is no defense. A written claim can also go to the department, with fifteen calendar days to ask for a hearing after its decision.
